Dear Deaver,

Should you read this I want you to know that I personally am calling you are a liar and a brigand to your face.

You have suggested and stated that I am not a reputable business man. You claim Courts of Law have stated that I sold you "Stolen Goods."

You are quoted as saying at http://www.spanishcastle.com/spacepirates/

"Lower court said "it didn't matter they were stolen.""

In fact no court has EVER once said that the materials I sold you were stolen or in any way not my property to sell. The truth is that that The Superior Court for the Commonwealth of Massachusetts accepted and upheld my Copyrights as issued by The US Copyright Office.

Don't you remember how we slapped your face in court when you tried to tell this one to the the Jury? You really don't remember us taking one of your supposed "re-done with our own materials" disks that we bought the day before trial, and putting it into a computer? We brought up Adobe Premiere 4.2, and listed the "File Information". We showed the court, the jury, and the world the Wrightwood Labs embedded Copyright notice?

I know I can still see the look on your face when you saw it for the first time just like the jury did. And I will NEVER forget the look on your face when I asked the jury, "If Deaver replaced all of our material with his own, why did he go to all the trouble to embedding a Wrightwood Labs Copyright?"

Unless you know something I do not know, CD-Titles was forced to withdraw their appeal. Something to do with lack of merit I believe.

"The supposed author was not like these artists who did great stuff; at best Wrightwood downloaded public domain materials. At worst he stole other people's stuff."

Deaver, again I say to you that you sir, are a liar! No material sold to you was ever stolen from anyone except by you from me. Additionally, no material ever submitted to you was EVER downloaded from the Internet. I know it. You know it. The Superior Court for the Commonwealth of Massachusetts told you so.

"Judge said CD Titles should have known it was stolen. We asked for proof of ownership and never got it." Deaver Brown, 

What the judge said and I paraphrase was this....If CD-Titles had any reason to believe there were any problems with any of the materials submitted by Wrightwood, CD-Titles had the time, the means, and materials to investigate prior to entering into any agreements with Wrightwood. Additionally had any problems been discovered, CD-Titles failed to notify Wrightwood and to provide Wrightwood Labs an opportunity to correct and cure. With regards to the request of proof of ownership, at the time of the request, you (CD-Titles) were already so far in breach of contract with Wrightwood, Wrightwood was under no obligation to comply with any terms of the contract or requests.

What I have to ask is, "Deaver, if anything you say about me is true, how did we win our law suit? Even if there were some extenuating circumstance of law that let us win, even though you were right, how did we then also win our 93A claim of Fraud against you?" "More over, of all the charges you filed against me in court, how come all were thrown out?"

Deaver, you're not a man. You really are nothing more then a common brigand. Stand up and be a man. Stop being such an embarrassment to your Harvard MBA and Entrepreneurs everywhere.

However, being that "I" am a man of honor I will make you an offer (since dueling is now illegal) to put up or shut up and pay up! If you can provide any transcript from any trial where ANY judge ever said the materials I sold you were "At best Wrightwood downloaded public domain materials. At worst he stole other people's stuff." Not only will I abandon any and all claims against you, I will publicly apologize for anything I may have said to disparage your honor. And, I will bend over and kiss your ass at high noon in Times Square on the day of your choosing.

Fortunately I am younger, healthier, and so determined that I will never stop hunting you down. You will pay for your misdeeds for this is no longer about the money...This is about honor and justice.
